The Supreme Court just handed the Trump administration the power to end Haitian TPS, and Mike Lawler is now pushing Congress to step in anyway.
Quick Take
- Lawler voted for H.R. 1689, which passed the House 223-204 and would extend Haiti’s Temporary Protected Status[3]
- He signed Discharge Petition No. 15 to force a House vote after leadership stalled the bill[1][5]
- After the Supreme Court ruling, Lawler said Haiti remains too dangerous for forced return[4][8]
- He is urging the Senate to take up the Haiti TPS bill now[4]
Lawler’s Split Role On Haiti TPS
Mike Lawler is under fire from the right because he keeps backing Haitian Temporary Protected Status, even after the Supreme Court gave President Trump broad room to end it. Lawler has also argued that Haiti is still too unstable for mass returns. That puts him at odds with voters who want a tougher line on immigration and less tolerance for endless TPS extensions.
Lawler’s record is clear. He co-led H.R. 1689 with Representative Laura Gillen and voted for the bill on April 16, 2026. The House passed it 223-204, and the measure now heads to the Senate. In his own statement, Lawler said Haiti still faces gang violence, political instability, and a deep humanitarian crisis, and he said people living and working legally in the United States should not be forced back into those conditions.[3]
Why The Supreme Court Ruling Changed The Fight
The Supreme Court ruling matters because it cut off a major legal path for TPS supporters. According to reporting on the decision, the Court said federal judges cannot second-guess the Department of Homeland Security on TPS termination decisions.[8] That means the fight now shifts from the courts to the White House and Congress. For Lawler, that makes his push for a Senate vote even more important, but also much harder.
Lawler tried to build support before the ruling too. In March, he signed Discharge Petition No. 15 to force a vote on H.R. 1689 after more than a year without action in the House.[1][5] He also joined local Rockland County officials in a letter to the White House urging TPS protection for Haitians, citing violence and human rights abuses in Haiti.[1] Those facts show he has been working this issue for months, not just reacting to the Court.
Why Critics Are Calling Him Out
Critics on the right say Lawler is doing the same old Washington routine: talking conservative, then protecting a program they see as a back door to permanent stay. That frustration is sharpened by the fact that Haiti has remained in crisis for years, yet TPS keeps getting extended instead of ending cleanly. Supporters of Lawler say the humanitarian case is still real. Opponents say the extensions only delay enforcement and reward lawlessness.

Lawler’s own words make the political tension plain. He said he does not dispute the president’s authority to end TPS, but he strongly disagrees with ending Haitian TPS right now.[4] He also urged the Senate to take up his bill and give Haitian TPS holders time while immigration cases play out.[4] That position may sound measured in Washington, but to many conservatives it looks like another soft landing for a system that never really ends.
What Happens Next In Congress
The next move belongs to the Senate, where H.R. 1689 now sits after House passage.[3] Lawler says lawmakers should act before the protections lapse and force a broader crisis. The White House, meanwhile, has every incentive to keep the pressure on for removals, which leaves little room for compromise. If the Senate does nothing, the administration’s position will likely stand, and Lawler’s bill will become another stalled promise.
