(PresidentialHill.com)- A US appeals court ruled on Friday that the Biden administration cannot compel healthcare providers to perform gender-transition surgeries because doing so would require them to infringe upon their religious liberties.
According to Reuters, the 8th US Circuit Court of Appeals three-judge panel unanimously agreed with a North Dakota judge that the Obama-era rule violates the plaintiff’s right to freedom of religion.
According to the judges, Title IX exempts from its restrictions “an educational institution which a religious organization controls if the application of this subsection would not be consistent with the religious tenets of such organization.” The ruling takes note of the administration’s Title IX arguments.
Contrary to the government’s claims, the court correctly concluded that the plaintiffs of the Catholic Benefits Association face a “credible threat” of enforcement from the Equal Employment Opportunity Commission, according to the decision.
As reported by Fox News: “In 2016, the Department of Health and Human Services promulgated a rule implementing the probation of discrimination under Section 1557 of the Affordable Care Act, also called Obamacare. The rule prohibits discrimination on the basis of gender in all health programs and requires doctors and hospitals who receive funding from HHS (including hospitals that accept Medicare or doctors who accept Medicaid) to treat individuals consistent with their gender identity.”
According to Luke Goodrich, VP and senior counsel at Becket, the federal government has no business compelling physicians to violate their consciences or carry out contentious procedures that could permanently harm their patients.

Goodrich stated that “today’s victory establishes an important precedent that religious healthcare professionals are free to practice medicine in accordance with their consciences and skilled professional judgment.”
The government’s attempt to force physicians to violate their consciences was detrimental to patients, physicians, and religious freedom.
